Publication of two opinions of the European Copyright Society on two cases (one pending, one decided) of the Court of Justice of the European Union (Cases C-683/17, « Cofemel » and C-161/17, « Cordoba »)
End October 2018, the European Copyright Society has published two new opinions on one pending case before the Court of Justice of the European Union regarding a Request for a preliminary ruling from the Supremo Tribunal de Justiça (Portugal) lodged on 6 December 2017 on the freedom of Member states to choose the level of originality pertaining to works of applied art, industrial designs and works of design, and another regarding a decision of the Court of Justice of 7 August 2018 following a request Request for a preliminary ruling from the Bundesgerichtshof (Germany) lodged on 31 March 2017 — Land Nordrhein-Westfalen v Dirk Renckhoff on the notion of making available of a copyrighted work on a website when the work is already freely accessible to all internet users on a third-party website with the consent of the copyright holder.

Christophe Geiger, Professor at the University of Strasbourg and Director General of the CEIPI, has participated to the drafting of the Opinion on the notion of making available to the public (“Cordoba”). He is a founding member of the European copyright society and has been its Chair from 2014- 2015.
