CEIPI is pleased to announce that Mr. Yann Basire, Associate Professor at CEIPI, has just taken up office as Director General of CEIPI, since 1^st September 2019, for a period of 5 years, following his election by the Council of Administration of CEIPI of 7 December 2018.

Mr. Basire, who is also Director of the French section of CEIPI, succeeds Prof. Christophe Geiger, with the objective of sustaining and strengthening the positioning of CEIPI as a center of excellence in training and research in intellectual property, both in France, Europe and internationally.

Yann Basire, PhD in Intellectual Property Law from CEIPI, is expert in industrial property law and, more specifically, trademark law. He is the author of several articles on the subject and is responsible for the chronicles “Marque de l’Union européenne” in the journals “Propriétés intellectuelles” and “Europe” and the annual synthesis “Droit des marques” in the journal “Légipresse”. He is also author and co-author of the book “L’essentiel du Droit de la propriété industrielle”, “L’essentiel du Droit de la propriété littéraire et artistique” in the Gualino Collection, as well as Director of “Revue Francophone de la Propriété intellectuelle”. He regularly participates in conferences in France and abroad, training (FNDE, IRPI) and seminars in intellectual property law. Since 2014, he organizes annual conferences abroad in order to compare the French vision of intellectual property with the vision of the host countries. Finally, since September 2018, he has been Director of the French section of CEIPI.

Professor Christophe Geiger, Director of the CEIPI Research Department, has been elected by the General Assembly of the ATRIP Association on 28 August 2019 in Nashville (USA), as the next President of the association for a term of two years, starting from 2021. He will succeed Professor Jens Schovsbo of the University of Copenhagen, who took office as President for the next two years at the end of the annual ATRIP congress in Nashville.

The ATRIP (International Association for the Advancement of Teaching and Research in Intellectual Property), founded in 1981, is one of the most prestigious associations working to contribute to the advancement of education and research in the field of intellectual property law.

The association organizes, among other activities, a major annual congress and an annual essays competition for young researchers in intellectual property.

CEIPI is proud to announce that the center has been selected for the third time as external expert for the JURI Committee (Legal Affairs) of the European Parliament, following the call for tenders to which CEIPI responded in February 2019, Framework contract on Expertise on Regulatory and Policy Issues in the Field of Intellectual Property Law. As a reminder, CEIPI has already been selected previously for 2 other framework contracts. By the past, the number of selected entities was unlimited (provided they met the selection criteria). This time, the Parliament has retained as experts only 5 entities, including CEIPI.

This Framework contract is intended to support the work of the Committee on Legal Affairs (JURI) of the European Parliament in the field of intellectual property law by enabling it to have access to expertise (through written studies and reports), as well as support of European Parliament events with external experts in the areas of competence of the JURI Committee.

We are pleased to announce the launch of a new training program now available at CEIPI, on “European Union Trade Mark and Community Design Law”.

This program, the first of its kind, focuses on EU Trade Mark and the EU legal framework on Community designs. It also includes lectures dealing with US and Japanese Laws. The program will be delivered over a period of 4 weeks starting in February and ending in May 2020. It is divided in four modules: Introduction to the EUTM system and absolute grounds of refusal, Relative ground: introduction to opposition proceedings, EU Trade Mark Litigation and design law. Faculty includes experienced attorneys, renowned professors and Members of the Board of appeal of the European Office Intellectual Property Office.

The program is conducted in English through lectures, seminars and workshops involving case studies.

CEIPI is pleased to announce the creation of a specific training course dedicated to artificial intelligence and intellectual property, the first of its kind.

The recent development of artificial intelligence applications has had a significant – and often fundamental - impact on a vast array of legal fields. Intellectual property rights have not been spared. From the development of algorithms that create musical or graphical works to the advent of automated processes that produce novel technical artefacts, from novel forms of infringements to the delicate issue of datasets management, the growing presence of these new algorithmic intermediaries challenges the whole gamut of IP rights.

Still, rare are the lawyers that possess sufficient expertise to accommodate in earnest these new algorithmic modalities. The present training has a dual objective: the first one is to endow legal professionals with an in-depth knowledge of the articulation between AI creations and IP rights, while the second is to provide them with a bespoke technical understanding of these objects.

The university diploma “Artificial Intelligence and Intellectual Property / Intelligence artificielle et Propriété intellectuelle” aims at addressing the specific demands of practitioners in the field of intellectual property rights. Indeed, while many training courses are being offered on digital technology and law, none of them focuses on the novel and unique challenges posed by artificial intelligence in the field of intellectual property rights. In order to understand and master the issues of protection of these new types of creation, their utility for the enforcement of rights, as well as their technical and economic environment, a dedicated training seems essential.

Another – rather unique - specificity of the present training is to offer an entire module dedicated to computer technology (Module 1: What is AI? Technical introduction and demystification). This module aims at bringing the legal professional up to speed with the latest developments in the field of AI and includes practical work and hands-on applications on coding, AI algorithms and data structures.

This combined approach brings a definite added value with respect to other teachings in France and Europe. Thus, at the end of the training, participants will be able to benefit not only from in-depth knowledge in artificial intelligence law, but also in computer technology.

CEIPI is offering its first advanced distance learning program.

The “IP Business Administration University Diploma” is dedicated to train specialists (attorneys and lawyers specialized in intellectual property) and non-specialists in intellectual property such as marketing experts, project managers, entrepreneurs as well as any person interested in the role of intellectual property in companies and its daily practice.
In addition to the fact that this new diploma addresses to non-specialists, this diploma is offering basic training courses in the management of intellectual property and can be potentially a “preparation” for the Master of Intellectual Property Law and Management (MIPLM).

This European Master’s program is designed especially for European patent attorneys, lawyers and other experienced IP professionals. Its ultimate objective is to qualify experienced IP professionals to act as IP managers with the practical skills and knowledge to deal with the new challenges of wealth creation and profit generation. Participants acquire first and foremost a new understanding of how intellectual property works in business models and are conveyed the necessary skills to achieve the systematic alignment of IP management and business objectives.

This Master addresses students and practitioners with a minimum of three years’ experience in the Intellectual Property field.

CEIPI offers a complete range of courses preparing for the European Qualifying Examination (EQE) 2020, using proprietary high-quality training material. The tutors for these courses are either professional representatives (from private practice and industry), or staff of the departments of first instance of the EPO and of the Boards of Appeal.

Several basic training courses in European Patent Law, designed to accompany professional practice of future Patent Attorneys and organized in currently 40 European cities, will started in autumn 2019.

Unique in Europe and in the world, this Summer School offers a two weeks training as theoretical as practical for both scientific and law backgrounds. In fact, the division of the course into two parts, the first devoted to a general stream and the second a specialized stream, during which students may opt for a “Patent path” or a “Trademark and Designs path” grants to this Summer School its specificity.

CEIPI is pleased to announce the offering of the 3^rd edition of the Advanced Training Program on “Artificial Intelligence and Intellectual Property” that will take place in Strasbourg from 23 to 25 April 2020. This new training follows the very successful editions of past years, gathering a high number of professionals coming from almost all the European countries, and as far as Brazil, Canada, United States, China, India, Malaysia and Japan, and including senior officials from renowned institutions.
Artificial Intelligence (AI) and robots have been the subject of science fiction for some time. That fictional future is now a present reality. The regulation of AI’s activities is set to become a primary policy issue. In particular, AI’s disruptive effects on traditional business models will force a re-consideration of the Intellectual Property (IP) framework. Today, AI and algorithms write news and novels, generate artworks, write and perform music. Automated intelligence can drive innovation processes on its own initiative. AI challenges the most traditional IP legal notions, such as “copying”, “originality”, “creator”, “author”, or “inventiveness”. Can a robot be an author? Can a robot be an inventor? Can a robot co-author a work with human intelligence? Who owns AI generated works or inventions? Should AI’s inventions be considered prior art? Who owns the dataset from which an artificial intelligence must learn? Who should be liable for creativity and innovation generated by AI, if they impinge upon others’ rights or other legal provisions? This training program will explore these thorny questions by dissecting legal, policy and ethical issues concerning AI impact on creativity and innovation. This training program should be of interest to creative economies and high-tech professionals and entrepreneurs, attorneys, policy makers, judges, and students.

Session 2020: 13-14 March and 17-18 April - Strasbourg

The Ceipi is happy to announce the 2020’s edition of the training program exclusively devoted to the Unified Patent Court (UPC) that will take place in Strasbourg in March and April 2020.

The program is divided in two modules of two days each (March 13-14 and April 17-18) and will allow participants to go through the institutional aspects of the UPC, the rules of procedure and remedies available to the parties.

This program is organized every year and is open to former participants of the Diploma on Patent Litigation in Europe, lawyers practicing in the area of intellectual property, and other intellectual property professionals with an interest in patent litigation and enforcement.

Registration to the new edition of the CEIPI advanced training on “Social Networks and Intellectual Property” is now open! The training program will take place in Strasbourg from 26 to 28 March 2020.

Social networks and online platforms define a considerable part of our daily interactions and activities. They have increasingly become a privileged venue for online business, in particular in the luxury and fashion industry. Promotion, protection and enforcement of Intellectual Property (IP) on social media and online platforms define the strategic success of any businesses nowadays. New professional figures, known as influencers, are emerging and changing the traditional landscape of brand promotion, use, licensing and online advertisement. As a lawyer, entrepreneur, influencer or policy maker working at the forefront of Internet and social media industry this changing social and market landscape becomes a puzzle with plenty of new complex questions to answer. How do you protect your content and your brand online, in particular on social media, digital marketplaces and user-generated content platforms? How do you promote content, brands or your own persona through the best licensing options? How web-based and mobile technologies can be protected? If you are an access provider, a social network, an online platform or website, which obligations apply to you? When are social networks, online platforms and websites liable for their users’ online activities?

This training program will explore legal, policy and practical issues facing online businesses and social media from a national and international perspective, with great emphasis on the European Digital Single Market. In this course, the participants will learn about novel issues of innovation regulation with special focus on content and brand protection, licensing and enforcement online, while considering social media and online platforms’ obligations and intermediate liability for copyright, trademark, and privacy infringement, including data protection obligations under the General Data Protection Regulation (GDPR). This training will also provide key notions regarding patentability, protection and business strategies related to web-based and mobile technology.

Participation to the CEPI Advanced Training on “Social Networks and Intellectual Property” will provide a competitive advantage to all those engaged with strategic decisions in the online environment, who are keen on profiting from fundamental changes in the way in which business interactions occur and want to leapfrog competitors. This program, that took place from 21 to 22 November 2019 in Strasbourg, was dedicated to train IP management executives in industry and institutions. Since 2006 the MIPLM program educates IP management skills to IP experts from all over the world. There is a growing and devel­oping best practice in business orientated IP management.

The workshops aimed to provide insight into industry specific aspects of IP strategy development, practical issues in systematic synthetic invention, IP protection of perceived customer benefits and sustainable organizational change in companies.

The workshop program was mainly addressed to IP professionals, but also for graduate students who are interested in these topics.

The framework was designed for inspired discussions and networking.

CEIPI launched in September 2019 a new Advanced Training Program on Regulatory Affairs and Intellectual Property Protection in the Pharmaceutical Industry, a unique educational proposal targeting regulatory and intellectual property professionals in the pharmaceutical sector. The three days of training revolved around the interface between patent law, supplementary protection certificates and test data protection.

This training program was addressed to regulatory officers, patent attorneys and in-house lawyers, as well as public servants working in public health organizations, who must navigate through the several legal domains of relevance in pharmaceutical research, development and innovation.

When it comes to pharmaceutical products, branches of law of administrative nature become tied to private law. The interfaces between pharmaceutical law, intellectual property law, competition law and consumer law are numerous. Patents, supplementary protection certificates and regulatory exclusivities, notably test data protection, make up a sophisticated legal framework of overlapping exclusivities that impact both on innovation and competition.

The CEIPI is happy to announce the publication of the third edition of “Les grands arrêts de la propriété intellectuelle” by Dalloz Editions, one of the leading professional and academic legal publishers in France.

Edited by Michel Vivant, this new volume of the famous legal casebook takes into account the evolution of the legal doctrine and proposes some more new analysis, written by eminent contributors including some members of the CEIPI Research Department.

CEIPI is pleased to announce the publication of a new volume at Edward Elgar, “Research Handbook on Intellectual Property and Investment Law”, edited by Christophe Geiger, Professor of Law and Director of the Research Department of CEIPI, forthcoming 2020.

This book brings together several interventions presented at the 19^th EIPIN Congress “Enforcing Intellectual Property in Trade and Investment Agreements: What Safeguards for its Social Function?”, that took place from 25-27 April 2018 at the European Parliament in Strasbourg, (click here for the video recordings of the conference) as well as original contributions written by experts in intellectual property law and investment law. It aims to become the first reference book on the relationship between intellectual property law and investment law.

This innovative Research Handbook explores the complex and controversial interactions between intellectual property (IP) and investment law. In light of recent developments at national, European and international levels, the chapters critically examine the legitimacy of current practices with regard to the social function of IP rights and the regulatory autonomy of States to undertake measures in the public interest.

In the framework of the series “Discussion around copyright”, organized by the CEIPI research department in partnership with the Kléber bookshop, under the scientific supervision of Franck Macrez, Associate Professor at CEIPI, University of Strasbourg, the CEIPI had the pleasure to organize a new edition of the series, that took place on Friday 29 November 2019, at Librairie Kléber (salle Blanche), Strasbourg.

The topic of this edition was “Open access, copyright law and flow of knowledge”,  with Mélanie Clément-Fontaine, Professor of Private Law at the University Saint-Quentin en Yvelynes, Université Paris Saclay and Yannick Hoarau, Deputy Vice-Chairperson Research Data and Open Science, University of Strasbourg.

This conference-debate was moderated by Franck Macrez, Associate Professor at CEIPI.

The Center for International Intellectual Property Studies (CEIPI) of the University of Strasbourg was pleased to organize a conference on the topic “Artificial Intelligence, Innovation and Intellectual Properties”. This conference, which was held under the high patronage of the Parliamentary Office for Evaluation of Scientific and Technological Assessment (OPECST) and Senator Ronan Le Gleut, took place on 7 November 2019 (Salle Clemenceau) at Luxembourg Palace, Paris.

The conference aimed to present the latest developments in the field of artificial intelligence and to confront them to the questions related to intellectual property rights. Thus, the concrete applications of artificial intelligence were presented in the main industrial sectors. These learning algorithms which pose difficulties of apprehension by the Law, the questions concerning the intellectual property rights (patent, copyright) were dealt, from the point of view of the artificial intelligence systems themselves, in terms of the results they produce, as well as the protection of the data themselves that feed these systems.

This event was held under the scientific supervision of Mr. Franck Macrez, Associate Professor at CEIPI, University of Strasbourg and Mr. Yann Basire, Associate Professor at CEIPI, Director General and Director of the French section of CEIPI, University of Strasbourg.

But above all, the common goal of students through the creation of this association is the organization of its own events. The association offers conferences on current issues, in collaboration with CEIPI professors and researchers.
