CEIPI is very pleased to announce the publication of Intellectual Property and the Judiciary, a book edited by Christophe Geiger, Professor of Law, Director General and Director of the Research Department, Center for International Intellectual Property Studies (CEIPI), University of Strasbourg, Craig Allen Nard, Galen J. Roush Professor of Law and Director, Spangenberg Center for Law, Technology and the Arts, Case Western Reserve University School of Law and Visiting Professor at the CEIPI, University of Strasbourg, and Xavier Seuba, Associate Professor of Law, Trainings Coordinator and Scientific Responsible, Center for International Intellectual Property Studies (CEIPI), University of Strasbourg. This book is the fourth volume in the European Intellectual Property Institutes Network Series (for previous volumes see www.eipin.org).

Intellectual Property and the Judiciary examines the role of the judiciary in the elaboration and interpretation of intellectual property law, exploring how intellectual property doctrine and policy are developed and the manner in which judges construct and apply norms in different court systems. The authors engage in a comparative study of various national, European and international judiciaries and appraise the competing and complementary roles of governing bodies.

Each chapter seeks to capture the comparative institutional advantages of government bodies within existing legal frameworks as well as offering a thorough examination of both the common law and civil law traditions in the context of judicial treatment of intellectual property. The result is a series of proposals relating to the architecture of judiciaries and the functional role of judges with the goal of optimally positioning jurists to address complex issues and advance intellectual property doctrine and policy.

Next April 2019 will take place in Strasbourg, organized by CEIPI, a new training program exclusively devoted to the Unified Patent Court (UPC). The program is divided in two modules of two days each (5-6 and 26-27 April 2019) and will allow participants to go through the institutional aspects of the UPC, the rules of procedure and remedies available to the parties.

Speakers in the previous edition of this program include Alexander Ramsay, Margot Fröhlinger, Klaus Grabinski, Kevin Mooney, Sam Granata, Beate Schmidt, Pierre Véron, Laurence Brüning-Petit, Thierry Debled, Stefan Luginbuehl and Christophe Geiger.

The program is open to former participants of the Diploma on Patent Litigation in Europe, lawyers practicing in the area of intellectual property, and other intellectual property professionals with an interest in patent litigation and enforcement.

Early November 2018, Professor Christophe Geiger, Director General and Director of the Research Department of CEIPI visited the Hanken School of Economics, Finland, as ‘visiting international faculty’, in order to give several lectures in the framework of the cooperation agreement between the IPR University Center and the CEIPI, in the presence of Ms. Nari Lee, Professor of Intellectual Property Law at the Hanken School of Economics.

Intellectual Property Rights (IPR) University Center, with whom CEIPI signed a cooperation agreement on 26 September 2016, brings together six of the most prestigious universities in Finland, namely: University of Helsinki, Aalto University, University of Turku, Hanken School of Economics, University of Eastern Finland and the University of Lapland.

Thanks to its archive in Open Access available under this link, the CEIPI is now quite clearly recognized in its action towards the green Open-Access distribution.

In order to contribute to the debate on the ongoing copyright reform at the EU level, CEIPI drafted an Opinion on the proposal to facilitate use of out-of-commerce works, as presented in the European Commission’s Proposal for a Directive on copyright in the Digital Single Market of 14 September 2016. Other topics of the reform are reviewed in separate position papers.

The Opinion supports the proposal to facilitate access to the European cultural heritage and its digitisation through the establishment of extended collective licensing of rights for out-of-commerce works. This opinion endorses the extension of the notion of “out-of-commerce works” to works never intended for commercial use and the possibility to determine the out-of-commerce status of a collection of works as a whole. At the same time, it proposes some amendments regarding the scope of out-of-commerce search, the representative character of collective management organisations, the sufficiency of general publicity measures on the use of out-of-commerce works, and the application of the mechanism to third-country works.

CEIPI follows and comments the main developments in the area of intellectual property at national, European and international levels. Development of a balanced and efficient intellectual property system of the European Union is of great interest to the centre. This Opinion follows the previous CEIPI Opinion on the proposed introduction of neighbouring rights for press publishers, CEIPI Opinion on exceptions and limitations to copyright as well as a Study for the Committee on Legal Affairs of the European Parliament on the exception for text and data mining.

Her research project focuses on “Copyright and Freedom of Expression in Europe: European Court of Human Right’s new approach and paradigm shift of the Cour de Cassation in France”.

- from 24 October to 3 December 2018, Mr. Henry Biggs, Adjunct Professor, International Intellectual Property (Law School), Washington University in St Louis. His research project focuses on the topic “Intellectual Property and Human Rights, understanding motivators to creative production”.

- from 7 January to 9 February 2019, Ms. Sapna Kumar, Law Foundation Professor of Law George Butler Research Professor, Co-director, Institute for Intellectual Property & Information Law, University of Houston, United States (Fulbright scholarship). Her research project focuses on the topic “Promoting Innovation Through Patent Unification: A Transatlantic Comparison”.

Ms. Franciska Schönherr, PhD of CEIPI, received on 9 October 2018 the prize of the Research federation “Europe in transition” for her thesis defended on 2^nd October 2017 within CEIPI’s Research Department “The construction of an EU Copyright Law: Towards a Balanced Institutional and Legal Framework”, written under the supervision of Professor Christophe Geiger, Director General and Director of the Research Department of CEIPI.

This thesis prize was created in 2012 in order to recognize the outstanding works of a PhD student whose thesis topic correspond to the European dimension of the Research Federation and to its main research areas. Four PhD candidates from CEIPI’s Research Department obtained the prize in 2014, 2015, 2016 and 2018.

Ms. Elena Izyumenko, Doctoral Candidate and Research Assistant at the CEIPI, has won the second prize at ATRIP’s Early Career Workshop with the presentation of her joint with Prof Christophe Geiger research on the topic “European ‘Fair Use’ Grounded in Freedom of Expression”.

The workshop was part of the ATRIP 37th Annual Congress on fairness, morality and ordre public in intellectual property law and policy and was held in Helsinki on the 5^th of August 2018. It required participants to present their research in 240 seconds.

On 23 November 2018, Mr. Thibaud Lelong defended his thesis on the topic “The monetization of intangible assets in the knowledge economy: an essay on securitization” written under the supervision of Mr. Yves Reboul, Emeritus Professor at the University of Strasbourg.

In the context of the lecture series “Institutional, political and social perspectives on intellectual property”, the CEIPI had the pleasure of welcoming on 27 November 2018, Mr. Martin Ekvad, President of the Community Plant Variety Office. The public lecture focused on the topic “Update of the case-law of the CJEU in the field of Community Plant Variety Rights”. The debate was moderated by Prof. Christophe Geiger, Director General of CEIPI. The conference was followed by the signature of a renewal of the collaboration agreement between CEIPI and the CPVO.

In the framework of the series “Discussion around copyright”, organized by the CEIPI research department in partnership with the Kléber bookshop, the CEIPI had the pleasure to organize a new edition of the series, that took place on Friday 16 November 2018, at Librairie Kléber (salle Blanche), Strasbourg.

The topic of this edition was “The trade secret: legitimate business protection or danger to the right to information?”, with Mr. Bertrand Warusfel, Professor at the University Paris 8, Lawyer at the Paris Bar, co-author of “The protection of Trade Secrets, National and European Perspectives”, CEIPI collection, LexisNexis, 2017 and Mr. Pierre France, Journalist, founder and director of the publication Rue 89 Strasbourg.

This conference-debate was moderated by Mr. Franck Macrez, Associate Professor at CEIPI.

On 19 October 2018, the BETA (Bureau Théorique d'Economie Appliquée) organized with the support of BETA/CEIPI Chair in Law, Economics and Management of Intellectual Property Rights, its first worshop oh the topic “Beyond patents…: towards new data for innovation research in economics”.

Mr. Christophe Geiger, Professor at the University of Strasbourg and Director General of the CEIPI, delivered a presentation on the topic “Rethinking exclusivity as a driver for innovation and creativity: The example of creative reuses of copyright protected works”.

The Center for International Intellectual Property Studies (CEIPI) of the University of Strasbourg organized, in partnership with the Institute Stanislas de Boufflers and the Association of Alumni of CEIPI (AACEIPI), the conference “Patent Law in France and in Europe”, that took place on 17 October 2018, in Paris (Cabinet August & Debouzy), under the scientific supervision of Matthieu Dhenne and Lionel Vial, President and Vice President of the Institut Stanislas de Boufflers and Prof. Christophe Geiger, Director General and Director of the CEIPI Research Department.

The first volume of the series is the book of Giancarlo Frosio, Senior Researcher and Lecturer at CEIPI “Reconciling Copyright with Cumulative Creativity: The Third Paradigm”, published in May 2018.

The volume examines the long history of creativity, from cave art to digital remix, in order to demonstrate a consistent disparity between the traditional cumulative mechanics of creativity and modern copyright policies. This work will appeal to all of those interested in both the history and future of creativity and copyright.

In this context, a presentation of this new collection and of Giancarlo Frosio’s book was scheduled on 11 October 2018 during a research seminar that took place at CEIPI.

The Center for International Intellectual Property Studies (CEIPI) of the University of Strasbourg and the Association of Young Academics Specialized in Intellectual Property (les JUSPI) organized the conference “Intellectual Property and Pop Culture: New Challenges and strategic issues?”. The conference took place on 9 October 2018, in Strasbourg at the Palais Universitaire, Room Pasteur and was held under the scientific direction of Mr. Yann Basire, Associate Professor at CEIPI, Director of the French section of CEIPI.

This conference brought to the center of the debate a topic of study often neglected by the legal practitioners: the pop culture. Major issue of the current cultural economy, the pop culture questions the law and, more particularly, intellectual property. This event, which focused on three area of research, tried to shed light on the new challenges and strategic issues that intellectual property must face in this field.

CEIPI was pleased to welcome Prof. Jerome Reichman, Bunyan S. Womble Professor of Law at Duke Law School, United States for a presentation on 13 September 2018, as part of the lecture series “(Re)Thinking Intellectual Property, Fundamental Questions and New Perspectives” as well as Guest of Honor of the Inaugural lecture for the academic year 2018-2019. His presentation focused on the topic “Reframing Intellectual Property Rights with Fewer Distortions of the Trade Paradigm”.

On 08 November 2018 was held in Strasbourg the meeting of the CEIPI Scientific Board of the Judiciary. The CEIPI Scientific Board of the Judiciary is the advisory body of CEIPI activities concerning judicial adjudication and enforcement, composed of prominent judges, high representatives of European institutions and renowned professionals. In the meeting, past activities of CEIPI in the area of judicial training were assessed and substantive, pedagogical and strategic aspects of the forthcoming trainings and scientific activities were addressed.

CEIPI is happy to announce the offering of a new edition of the Advanced Training Program on “Artificial Intelligence and Intellectual Property” that will take place in Strasbourg from 16 to 18 May 2019.

Artificial Intelligence (AI) and robots have been the subject of science fiction for some time. That fictional future is now a present reality. The AI market is predicted to grow from $8billion in 2016 to more than $47 billion in 2020. Investment in AI increased more than 300 percent in 2017 compared to 2016. Intelligent machines, machine learning algorithms, sapient bots and neural networks have invaded our daily life. Humans will be increasingly called to interact with AI, especially in the digital environment. The regulation of AI’s activities is set to become a primary policy issue. Lawyers, entrepreneurs, or policy makers must fast learn about the key legal challenges that AI will bring about, if they want to play a role in a revolution that will occupy the policy debate for the next years to come and beyond.

In particular, AI’s disruptive effects on traditional business models will force a re-consideration of the Intellectual Property (IP) framework. Today, AI and algorithms write news and novels, generate artworks, write and perform music. Automated intelligence can drive innovation processes on its own initiative. AI challenges the most traditional IP legal notions, such as “copying”, “originality”, “creator”, “author”, or “inventiveness”. Can a robot be an author? Can a robot be an inventor? Can a robot co-author a work with human intelligence? Should AI’s inventions be considered prior art? Who owns the dataset from which an artificial intelligence must learn? Who should be liable for creativity and innovation generated by AI, if they impinge upon others’ rights or other legal provisions?

This training program will explore these thorny questions by dissecting legal, policy and ethical issues concerning AI impact on creativity and innovation. In this course, CEIPI will gather leading experts in the field to discuss these novel issues from a broader international perspective and make sense of inconsistent and inadequate national solutions. This training program should be of interest to creative economies and high-tech professionals and entrepreneurs, attorneys, policy makers, judges, and students.

The CEIPI/WIPO/INPI Advanced Training Course on Intellectual Property, Technology Transfer and Licensing will take place from 11 to 21 June 2019 in Strasbourg. This training course is jointly organized since 1978 by the World Intellectual Property Organization (WIPO), the Centre for International Intellectual Property Studies (CEIPI) and the French National Institute of Industrial Property (INPI). Like in the past edition, the present course touches upon the legal and economic aspects of technology transfer and licensing. 

The training is addressed to technology transfer professionals, including professionals working in university technology transfer offices, national and regional intellectual property offices and science and technology ministries. With an integrated and practical approach, the CEIPI/WIPO/INPI Advanced Training Course on Intellectual Property, Technology Transfer and Licensing will be also of the interest of lawyers and economists.

Participants benefit from the expertise of specialists from several international organizations, prestigious research institutes and universities, and renowned experts, while interacting with professionals coming from all over the world. The interest of the program for developed, emerging and developing economies makes it a unique forum to exchange experiences and share opportunities.

CEIPI is pleased to organize the second edition of the CEIPI advanced training program on “Internet Platforms, GDPR and Intellectual Property Enforcement”. The training program takes place in Strasbourg from 6 to 8 December 2018.

Content

This training program explore legal, policy and ethical issues facing online businesses and intermediaries from a national and international perspective. In this course, the participants will learn about novel issues of Internet jurisdiction and innovation regulation. The course discusses the legal framework, case law and enforcement strategies dealing with intermediate liability for copyright, trademark, and privacy infringement, including a broader overview of data protection obligations emerging under the newly enacted General Data Protection Regulation (GDPR). It provides key notions regarding patentability, protection and business strategies related to web-based and mobile technology. Also, this course focuses on the role of Internet platforms and service providers in moderating the speech they carry for customers, including obligations and liabilities for defamation, hate and dangerous speech.

The training program pays great attention to online platforms’ regulation within the GDPR and the upcoming Digital Single Market (DSM) reform package in Europe. It exposes participants to most recent caselaw from European and other international courts, while providing state-of-the-art understanding of the legal aspects of Internet technology and recent intermediary liability trends online.

Audience

As a lawyer, entrepreneur, or policy maker working at the forefront of Internet and technology industry, you must know how web-based and mobile technologies can be protected, which obligations apply to access providers and communications platforms like Google, Twitter and Facebook, and whether and when they are liable for their users’ online activities. These are critical emerging issues for online businesses and key factors that affect innovation.

This training program would gather together media, creative economies, and high-tech professionals and entrepreneurs, lawyers, policy makers, judges, and students.

This program, took place from 29 to 30 November 2018 in Strasbourg, and was dedicated to train IP management executives in industry and institutions. Since 2006 the MIPLM program educates IP management skills to IP experts from all over the world. There is a growing and devel­oping best practice in business orientated IP management.

The workshops aimed to provide insight into industry specific aspects of IP strategy development, practical issues in systematic synthetic invention, IP protection of perceived customer benefits and sustainable organizational change in companies.

The workshop program was mainly addressed to IP professionals, but also for graduate students who were interested in these topics.

The framework is designed for inspired discussions and networking.

The graduation Ceremony of the CEIPI’s Masters Programs, academic Year 2017-2018, organized by CEIPI’s alumni, the AACEIPI (Association des amis du Centre d'études internationales de la propriété intellectuelle) took place on Wednesday, 17 October 2018 at the law firm August & Debouzy, in Paris and was followed by a cocktail reception.

The current basic training in European patent law has started in autumn 2018, with 6 courses having opened in different locations in Europe since September 2018.

In the framework of their partnership, CEIPI of the University of Strasbourg and the Law School of the Vanderbilt University (Nashville, Tennessee) announce the renewal of the special scholarship meant for a CEIPI student for obtaining an LLM in USA. This scholarship of 30 000 $ is going along with a position (remunerated according to the application rates) of research assistant on intellectual property (the exam period won’t be paid) under the supervision of Prof. Daniel Gervais. This scholarship is available for academic year 2019-2020 (beginning of the courses in August 2019). A similar scholarship will be provided each year.

The LLM degree of Vanderbilt allows students to take the Bar exams, especially the New York’s one. About sixty students from Europe, Latin America, Asia and Africa are accepted into the LLM programme each year. The LLM programme is fully integrated into the JD (Juris Doctor degree or Doctor of Law degree) programme and enables students to register to the same courses. An intensive and optional legal English course is also provided in July.

The scholarship recipient will be chosen jointly by CEIPI and Vanderbilt.
