A new 66th volume released in the CEIPI’s Collection : “The protection of Trade Secrets, National and European Perspectives”, co-directed by Professors Jean Lapousterle and Bertrand Warusfel
The CEIPI is happy to announce the publication of the 66th volume “The protection of Trade Secrets: National and European Perspectives ” with LexisNexis, in December 2017. Co-directed by Jean Lapousterle, Professor and former member of the Research Department of CEIPI and Bertrand Warusfel, Professor at Law of the University of Lille 2, the publication extends the symposium organized by the CEIPI’s Research Department, in partnership with the University of Lille 2 and the Compagnie Nationale des Conseils en Propriété Industrielle (CNCPI) on April 1, 2016, at the Palais du Luxembourg, in Paris.
The protection of trade secrets is of great interest to French and European companies and has close ties with the intellectual property law. The secret can thus represent an alternative to the protection conferred by the patent law when the strategic choice not to disclose the invention is made. In addition, it offers de facto protection to the elements that do not meet the conditions laid down in the Intellectual Property Code for the grant of exclusive rights.
Is it appropriate to strengthen the position of the trade secrets holders by sanctioning attempts to misappropriate or to outmaneuver them? The European Union thought so by recently adopting the Directive 2016/943 on the protection of undisclosed know-how and business information (trade secrets).
More than a year after the adoption of this text, the lengthy mechanics of the preparatory work seems to be initiated in order to transpose it in the different Member States. The movement will not elude France and we can expect to witness a resurgence of the disagreements and debates that consistently accompany the legislative work relating to this particular category of secrets. Numerous questions are raised and challenge business lawyers, barristers, journalists, whistleblowers and employees inclined to share the know-how acquired in previous positions with their new employers.
What is the legal nature of these trade secrets? How to define them? How to reconcile them with their potential impact on the holders of fundamental rights? What is the significance of the directive and how does it intend to preserve the confidentiality of secrets in the course of a trial? What are the omissions of the harmonization and are they likely to manifest themselves during the transposition?
These are some of the questions that this book addresses, its ambition being to contribute to the debate on the contours of a balanced protection of trade secrets.
The book includes the contributions of Adrien Basdevant, Nicolas Binctin, Christophe-André Frassa, Jean-Marie Garinot, Florence G’Sell, Jean Lapousterle, Constance Le Grip, Alain Michelet, Arnaud Martinon, Jean-Pierre Mignard, Jean Passa, Joëlle Simon, Bertrand Warusfel, Régis Vabres.

New CEIPI’s advanced training program on “Artificial Intelligence and Intellectual Property”, 24-26 May 2018, Strasbourg: registration is opened!

CEIPI is happy to announce the offering of a new Advanced Training Program on “Artificial Intelligence and Intellectual Property” that will take place in Strasbourg from 24 to 26 May 2018.
Artificial Intelligence (AI) and robots have been the subject of science fiction for some time. That fictional future is now a present reality. The AI market is predicted to grow from $8 billion in 2016 to more than $47 billion in 2020. Investment in AI increased more than 300 percent in 2017 compared to 2016. Intelligent machines, machine learning algorithms, sapient bots and neural networks have invaded our daily life. Humans will be increasingly called to interact with AI, especially in the digital environment. The regulation of AI’s activities is set to become a primary policy issue. Lawyers, entrepreneurs, or policy makers must fast learn about the key legal challenges that AI will bring about, if they want to play a role in a revolution that will occupy the policy debate for the next years to come and beyond.
In particular, AI’s disruptive effects on traditional business models will force a re-consideration of the Intellectual Property (IP) framework. Today, AI and algorithms write news and novels, generate artworks, write and perform music. Automated intelligence can drive innovation processes on its own initiative. AI challenges the most traditional IP legal notions, such as “copying”, “originality”, “creator”, “author”, or “inventiveness”. Can a robot be an author? Can a robot be an inventor? Can a robot co-author a work with human intelligence? Who owns AI generated works or inventions? Should AI’s inventions be considered prior art? Who owns the dataset from which an artificial intelligence must learn? Who should be liable for creativity and innovation generated by AI, if they impinge upon others’ rights or other legal provisions?
This training program will explore these thorny questions by dissecting legal, policy and ethical issues concerning AI impact on creativity and innovation. In this course, CEIPI will gather leading experts in the field to discuss these novel issues from a broader international perspective, reviewing miscellaneous—and often inconsistent—national solutions. This training program should be of interest to creative economies and high-tech professionals and entrepreneurs, attorneys, policy makers, judges, and students.
The program will be available soon on our Internet site.

The fourth issue of the CEIPI/ICTSD series “Current Alliances in International Intellectual Property Lawmaking: The emergence and Impact of the Mega-Regionals”

The Center for International Intellectual Property Studies (CEIPI) is pleased to announce the publication of the fourth issue in the CEIPI/ICTSD series on Global Perspectives and Challenges for the Intellectual Property System, produced jointly with the International Centre for Trade and Sustainable Development (ICTSD).
This new issue, Current Alliances in International Intellectual Property Lawmaking: The emergence and Impact of the Mega-Regionals, edited by Pedro Roffe, Senior Associate at the International Centre for Trade and Sustainable Development and Xavier Seuba, Senior Lecturer, Academic Coordinator and Judicial Training Manager at CEIPI, explores the impact of plurilateralism agreements on trade related international intellectual property law.
The chapters making up this volume review systemic, substantive and enforcement-related issues arising from plurilateralism, and do so by analysing the past, the current context and the most recently negotiated plurilateral trade agreements. Times have clearly been turbulent for global trade. Mounting critiques on the apparent failure of trade to enhance productivity, investment and technology flows have only been met with a greater slump in the growth of global trade and the rise of protectionism. At the same time, the number of free trade agreements has burgeoned as a result of longstanding disagreements, between countries at the multilateral level on a variety of issues.
Against this backdrop, this volume gathers contributions by well-known researchers in International Law, International Trade and Intellectual Property Law, writing from distinctive perspectives and reflecting on the systemic consequences of plurilateralism and the implications of these trends for the international system, with contributions by Thomas Cottier, Frederick M. Abbott, Mira Burri, Peter K. Yu, Padmashree Gehl Sampath, Pedro Roffe and Xavier Seuba.
The CEIPI-ICTSD publication series provides high quality academic and policy-oriented papers dealing with topics that are of global relevance because of their normative pre-eminence, economic relevance, and socio-economic impact.
The previous issues in the series can be consulted at:
- Intellectual Property and Access to Science and Culture: Convergence or Conflict? (Issue 3 – November 2016)
- Specialised Intellectual Property Courts - Issues and Challenges (Issue 2 - March 2016)

The CEIPI is happy to announce the upcoming publication of Xavier Seuba, Senior Lecturer, Training Coordinator and Judicial Training Manager at CEIPI, scheduled for September 2017, “The Global Regime for the Enforcement of Intellectual Property Rights”, Cambridge University Press.
This book offers a comprehensive description of the international norms and bodies dealing with the enforcement of intellectual property rights, and analyzes multilateral, plurilateral, and bilateral treaties, and their national implementation, along with civil, border, and criminal enforcement. The book also explores the interface between the enforcement of intellectual property rights and the norms regulating international trade, competition, and human rights, as well as the conceptual and systemic aspects of enforcement, while illustrating the importance of these rights with examples in litigation.

New Opinion of CEIPI on the European Commission’s Proposal to Reform Copyright Exceptions and Limitations in the EU
In order to contribute to the work on the ongoing copyright reform at the EU level, CEIPI drafted an Opinion on the proposal to amend the existing system of exceptions and limitations to copyright in the EU, as presented in the European Commission’s Proposal for a Directive on copyright in the Digital Single Market of 14 September 2016. Other topics of the reform are reviewed in separate position papers.
The Opinion supports the Commission’s proposal to introduce mandatory exceptions and limitations, promoting harmonisation and facilitating thus the creation of the Digital Single Market. The document provides a preliminary assessment of the proposed exceptions and limitations, draws attention to their selected aspects and considers room for improvement where necessary. The analysis focuses on the provisions of the Directive Proposal on text and data mining, on teaching activities and on preservation of cultural heritage. More generally, the Opinion recommends extending the scope of the reform by rendering other exceptions and limitations mandatory and by creating, in addition to the listed exempted uses, an opening clause that would secure the adaptability of the system in the future to new social, economic and technological developments. Such an opening clause would provide the legal framework with the necessary flexibility to address new uses justified by important public interest rationales not covered by the existing exceptions and limitations.
CEIPI follows and comments the main developments in the area of intellectual property at national, European and international levels. Development of a balanced and efficient intellectual property system of the European Union is of great interest to the centre. This Opinion follows the previous CEIPI Opinion on the proposed introduction of neighbouring rights for press publishers.

Conference-debate “Discussion around copyright”, Librairie Kléber, Strasbourg, moderated by Franck Macrez, 12 January 2018

In the framework of the “Lecture series of Kléber Bookshop”, which brighten up the cultural life of the city of Strasbourg, CEIPI organizes monthly conference-debate on current issues of copyright.
Intellectual property is no longer, today, only a matter of specialized lawyers, but a regular topic of the public debate, especially thanks to the digital revolution but also thanks to its influence on fundamental societal questions, such as access to knowledge or the appropriation of living things. The upcoming European Commission's copyright reform and other international treaty negotiations show the importance and topicality of these subjects. The topic of these lectures will focus on issues related to copyright and neighboring rights, as well as issues related to the evolution of patent law and trademark law.
The fact that the “intellectual property is part of the public debate” leads the CEIPI of wanting to bring its knowledge and know-how in the framework of open debates and broadly participatory as possible, and no longer only to specialists and students in Law.
These lectures will be moderated by Mr. Franck Macrez, Associate Professor at CEIPI. Speakers will be academics, practitioners (legal practitioners, lawyers ...), journalists, politicians (institutional, parliamentarians ...), business leaders.
