Forthcoming closing of Registrations to the Conference celebrating the 50th anniversary of CEIPI
The Center for International Intellectual Property Studies (CEIPI) is celebrating this year its 50th anniversary.
The highlight of the celebrations will be an international conference organized on 27th and 28th November 2014 at the Council of Europe in Strasbourg on the topic “Perspectives for the Intellectual Property System in a Globalized World” under the high patronage of the OHIM, EPO and WIPO.
The most important figures of intellectual property have agreed to speak at the conference and to support this important event.
Among the participants, we are counting prominent names from academia, IP organisations, legal firms, IP consulting and IP managers of major international companies.
Registrations started on 1st July 2014 and the number of places at the Council of Europe is limited. There are only a few places left, so, please, do not hesitate to register as soon as possible.

Ceremony in honour of Mr. Dieter Stauder, receiving the mention of “Honorary Tutor” from the international section of the CEIPI
The International Section is proud to announce that the first “Honorary Tutor” distinction has been awarded to Mr. Dieter Stauder, in October 2014, in the presence of several tutors of the section. The CEIPI expressed this way its gratitude to Mr. Stauder, former director of the International Section and D tutor from 1992 to 2010, for his experience and his immense contribution to the development of activities of the section.

PARTNERSHIPS
Two new partnerships have been signed recently between the CEIPI and prestigious institutions and universities active in the field of Intellectual Property.
Europe
Cooperation agreement between CEIPI and Community Plant Variety Office (CPVO)
Established in 1995, the Community Plant Variety Office (CPVO) is the European body responsible for ensuring the implementation of the Community system of protection of plant varieties. Since 1997, its headquarters are in Angers (France).
CEIPI and CPVO are collaborating since several years. To strengthen their relationship, they have decided to sign a framework cooperation agreement.
This partnership will allow them to share knowledge and experiences in the intellectual property field, to exchange about research subjects linked to community plant variety rights, to organize common events and internship collaboration.
The agreement was signed on October 1st, 2014, during a celebration held at the CEIPI, and with the participation in particular of the President of the CPVO, Mr. Martin Ekvad, the President of the University of Strasbourg, Mr. Alain Beretz and the Director General of CEIPI, Mr. Christophe Geiger.

International
CEIPI is reinforcing its position in Asia by formalising the cooperation with the Chinese-German Institute for Intellectual Property (Huazhong University of Science and Technology – HUST).
CEIPI and the Chinese-German Institute for Intellectual Property - HUST finalize a cooperation agreement
On October 8th 2014, the CEIPI (University of Strasbourg) and the Chinese-German Institute for Intellectual Property (HUST) have signed a Cooperation Agreement, with the aim to create common programs for training and research in intellectual property, exchange of students and staff and the organization of joint events. In particular, discussions were initiated in order to create at the Huazhong University a Sino-European Centre for Intellectual Property in partnership with the CEIPI.

UPCOMING CONFERENCES AT CEIPI
CEIPI-BETA project in Law and Economics of Intellectual property
This joint research project at the University of Strasbourg brings together lawyers and economists to formulate a common methodology and scientific output on a broad range of IP related issues. Directed by Mr. Christophe Geiger, Director General at CEIPI, and Prof. Julien Pénin, Associate Director at BETA (Bureau of Theoretical and Applied Economics), it is inter alia implemented through monthly workshops.

On Monday, December 1st, 2014, CEIPI-BETA Project in Law and Economics of IP has the pleasure of welcoming Prof. Dan L. Burk, UC Irvine's Chancellor's Professor in Law, who will give a presentation on the topic “Inventing around Copyright”.

2014 Lecture series “Institutional, Political and Social Perspectives on Intellectual Property” of the CEIPI
Conference of Ms. Margot Fröhlinger on the topic “The Implementation of the Unitary Patent and the Unified Patent Court - Current state and future perspectives”
In the context of the lecture series “Institutional, Political and Social Perspectives on Intellectual Property”, CEIPI had the great honor to welcome Ms. Margot Fröhlinger, Principal Director for patent law and international affairs at the European Patent Office, who gave a public conference on the current state of implementation of the Unitary Patent System and the Unified Patent Court.
Ms Fröhlinger did not limit her presentation to the theoretical aspects of the system and its foundations, but also chose to address many practical issues, the challenges and opportunities raised for various industrial sectors that will soon be using the system. Her presentation was introduced by Mr. Antonio Campinos, President of the OHIM and President of the CEIPI Administrative Board.

Round table organized by the CEIPI and the CPVO on the topic: “The Community plant variety system: Challenges and Opportunities”
The CEIPI and the Community Plant Variety Office (CPVO) have organized a round table on October 1st 2014, on the topic “The Community plant variety system: Challenges and Opportunities”. This round table permitted to present the role of the CPVO in the EU IP system, as well as some crucial legal issues, as interpreted by the Board of Appeal and the CJEU, as well as enforcement mechanisms, and the promotion of biodiversity through the mechanisms of open licenses. This ambitious program, enriched by discussions with the public, gave CEIPI students and researchers the opportunity to improve their knowledge of this very specialised and understudied IP field.
The round table was composed by: Mr. Christophe Geiger, Director General of CEIPI, Mr. Martin Ekvad, President of CPVO, Mr. Paul van der Kooij, Senior Lecturer at the University of Leiden, Chairman of the Board of Appeal of the CPVO, Mr. Théo Hassler, Professor at CEIPI, Ms. Geertrui van Overwalle, Professor of IP Law at the K.U.Leuven, Belgium.
On this occasion, the CEIPI and the CPVO have signed a framework agreement in order to raise public awareness and knowledge about community plant variety rights, area of intellectual property sometimes neglected in the academic classical programs.

Paris Congress on Industrial Property on the Topic “The legal framework for Employee’s inventions: Asia – USA – Europe”, organized by the FNDE, in collaboration with CEIPI and CASRIP
The National Federation for Corporate Law (FNDE) in collaboration with CEIPI and the Center for Advanced Study & Research on Intellectual Property (CASRIP), University of Washington have organized the Paris Congress on Industrial Property on the topic “The legal framework for Employee’s inventions: Asia - USA - Europe”,
This conference was held on September 19, 2014 in Paris.
Mr. Christophe Geiger, Director General and Director of the Research Department of CEIPI, has delivered the welcome address and Mr. Yves Reboul, Professor Emeritus and Director of the French Section of CEIPI, has spoken during the closing ceremony.

New Publication in the CEIPI Collection: Les fonctions de la marque by Yann Basire
We are delighted to announce the upcoming publication of a book by Yann Basire, Associate Professor at University of Haute-Alsace and member of CEIPI Research Deparment. This new book in the CEIPI Collection by LexisNexis, titled The functions of a trademark, essay on the coherence of the legal regime governing a distinctive sign, will be available for purchase in January 2015. The preface is signed by Mr. Yves Reboul, Emeritus Professor at the University of Strasbourg and Director of CEIPI French Section, and the foreword by Christophe Geiger, Director General of CEIPI.
Through the Court of Justice’s interpretation of the Trademarks Directive the function of the trademark has become a crucial subject of trademark law. The essential function of a trademark, which is to guarantee the identity of the origin of goods, is henceforth almost systematically appraised by Community and national judges at all stages of the life of a trademark. In 2009, the Court of Justice “discovered” four new functions: advertisement, investment, quality and communication. This progress has blurred the limits and boundaries of trademark law. The trademark, a business’s intangible asset, whose initial function is to make it possible to identify products or services, takes on loosely-defined functions, that are legally questionable, and commercial or consumerist. It is quite legitimate to question the role of the trademark today. Is it still the object of an intellectual property right that benefits its holder, or has it become a “complex” sign with multiple boundaries serving the consumer. This is the question that the present study intends to answer. The aim is to demonstrate the coherence of the legal regime of the most valuable and the most fascinating of distinctive signs.

Research Handbook on Human Rights and Intellectual Property is a comprehensive volume on the intersection of human rights and intellectual property law. Resulting from a field-specific expertise of over 40 scholars and professionals of world renown, the book explores practical and doctrinal implications of human rights considerations on intellectual property law and jurisprudence.

TRAINING AND EDUCATION
Opening of the fifth edition of the double degree programme CEIPI / University Ss. Cyril and Methodius in Skopje

The opening ceremony for the 2014-2015 academic year of the CEIPI double degree program on IP Law offered in cooperation with Ss. Cyril and Methodius University in Skopje (Macedonia), and in partnership with the EIPIN members, took place on November 4th 2014, in the premises of the Faculty of Law “Iustinianus Primus” of Ss. Cyril and Methodius University in Skopje.
Mr. Xavier Vermandele, Senior Legal Counsellor in the Building Respect for IP Division of the World Intellectual Property Organization (WIPO), gave an opening lecture on the topic “IP Enforcement and Building Respect for IP at the international level”.
This innovative training program in Skopje focuses mainly on international and European perspectives of IP Law (industrial property, copyright, neighboring rights and other related disciplines). Classes are taught by lecturers from CEIPI, its EIPIN partners, Law Faculties of Skopje and neighboring countries (Greece, Bulgaria and Serbia).

Academic year 2014-2015 at CEIPI

On September 15th, 2014, the CEIPI has welcomed new students of the University Diploma on Patent law, followed a few days later by the Masters 2, the University Diploma on Trademarks and Designs and the Diploma on Patent Litigation in Europe.
Around 1 000 applications were received for the professional and research master programs. 39 candidates were selected for the professional masters, whereas for the research Master 2 in European and international IP Law 14 students were admitted by the selection committee. As every year, a lot of applications were sent by foreign students, and the CEIPI is proud to welcome them at the same conditions as French students.
The CEIPI trains every year several hundreds of specialists (engineers and scientists with University degrees, lawyers with legal or equivalent Master I degrees, professionals willing to improve their knowledge) to the different professions of the Intellectual Property.
Training courses for the preparation of the European Qualifying Examination (EQE)
The courses preparing for the EQE 2015 which are organised by the International section of the CEIPI have started in September and October 2014 with the so-called PrePrep courses. Like every year, a great number of candidates have attended these seminars that have been held in Paris and Strasbourg in the three official languages of the European Patent Office, English, German and French.
The seminars preparing for the EQE take place as follows:
- seminar preparing for the EQE pre-examination: 3 - 7 November 2014
- seminar ABC: 17 - 21 November 2014
- seminar D: 5 - 9 and 19 - 23 January 2015.
These seminars are organized in the three official languages of the EPO, too, and take place in Strasbourg.

Basic training courses in European Patent Law have started in September or October 2014 in several European cities. We are glad to announce the start of the Istanbul course with more than 40 participants. Further courses will start in January or February 2015. Enrolments for these courses can still be sent to the International section.

CEIPI has become a founding member of the Pan-European Seal Professional Traineeship Program, launched by the OHIM and EPO in 2014

The aim of the program is to bring closer the academia and the labour market. It is organized in partnership by the OHIM and EPO, together with their strategic university partners. Members of the European Intellectual Property Institutes Network (EIPIN) have been chosen at the origin of the project to be strategic partners.
This year, five CEIPI graduates have been selected for a traineeship at the OHIM. Ms. Solen Charlou, Ms. Cindy Barel, Ms. Léa Rudloff, Mr. Sylvain Akriche and Mr. Laurent Leopold Metzger were selected for the first edition of a one-year paid traineeship in the framework of the Pan-European Seal Professional Traineeship Program. They will be working at the Cabinet (Presidency), International Cooperation and Legal Affairs Department (ICLAD) - Brussels Liaison Office, Operations Department and Customer Service Department.
In 2015, traineeships will also be offered at the EPO. In total, OHIM and EPO intend to offer 100 traineeships (50 each) annually.

Edition 2014 of the AACEIPI cocktail
The 2014 edition of the AACEIPI cocktail (Association of Friends of the CEIPI) was held on October 9th, 2014 at the “Union des Fabricants” in Paris. This traditional event is an opportunity to congratulate all the 2013-2014 CEIPI master students and to celebrate the best students of this year promotion who were invited to share their experience.

The European Institute for Enterprise and Intellectual Property has organized on October 9-10, 2014 in its headquarters in Illkirch a conference on the topic “IP and technology transfer: what economic impacts?”. Mr. Oleksandr Bulayenko, Research Assistant and Doctoral Candidate at CEIPI, has participated in the annual doctoral conference organized by the World Trade Institute (WTI), University of Bern, in Montreux, Switzerland.
Mr. Oleksandr Bulayenko delivered a presentation on the topic: “Collective Management of Copyright and International Trade”.

Laure Marino participated in the round table: "Intrusions dans la vie privée des personnalités publiques" and, more specifically, in the third round table: "La consécration par la CJUE d'un droit de désindexation par les moteurs de recherche (principe, exceptions et mise en œuvre)".

Mr. Christophe Geiger and Ms. Elena Izyumenko speaking at the 6th Conference of the Research Federation entitled “Relations Between the Council of Europe and the European Union: Complementarity or Competition?”
Mr. Christophe Geiger, Associate Professor, Director General and Director of the Research Department of the CEIPI, and Ms. Elena Izyumenko, Doctoral Student and Research Assistant at the CEIPI, have participated in the Sixth Annual Conference organized by the Research Federation of the University of Strasbourg “L’Europe en mutation” to take place on 2-3 October 2014 in Strasbourg. The theme of this year’s event was “Relations Between the Council of Europe and the European Union: Complementarity or Competition?”
Mr. Christophe Geiger and Ms. Elena Izyumenko have delivered a presentation on the topic: “The Influence of the European Court of Human Rights on the Intellectual Property Framework of the EU”.
The presentation has to some extent draw on the following publication by Mr. Christophe Geiger and Ms. Elena Izyumenko recently appeared in the International Review of Intellectual Property and Competition Law (IIC): “Copyright on the Human Rights’ Trial: Redefining the Boundaries of Exclusivity through Freedom of Expression”, 45(3) IIC 316 (2014).

The CEIPI at the symposium organized by the “Chaire Innovation & Brevets” in partnership with the IAE Aix en Provence on the topic: “Les nouveaux usages du brevet”
The CEIPI has participate in the symposium organized by the "Chaire Innovation & Brevets” in partnership with the IAE Aix en Provence, which took place on September 26 and 27, 2014 at the Faculty of Law and Political Science of Aix en Provence on the topic “Les nouveaux usages du brevet”.
Ms. Laure Marino, Professor at the University of Strasbourg and at CEIPI has delivered a presentation on the topic “La guerre des brevets Apple Samsung: le brevet comme arme anticoncurrentielle”.
Prof. Yves Reboul, Director of the French Section of CEIPI and Emeritus Professor at the University of Strasbourg, was in charge of summarising this symposium and to draw conclusions in a closing speech.

Christophe Geiger, Director General of the CEIPI, has delivered a presentation in the framework of the Roundtable “Analysing the Judges”, European Patent Reform Forum 2014 organized by Managing Intellectual Property, which took place in Paris, on September 11, 2014.
Christophe Geiger spoke on the topic: “Ensuring the success of the Unified Patent Court: the crucial importance of judicial training”.

Research trip of Mr. Oleksandr Bulayenko in Norway
Between August 30th and September 8th, 2014, Mr Oleksandr Bulayenko, Research Assistant and Doctoral Candidate at CEIPI, undertook a trip to Norway (Oslo and Stavanger), where he met and interviewed the representatives of collective management organization (GRAMO, TONO, Kopinor) and other representatives from the creative industries (IFPI Norge, Music Norway, Norcode, National Library of Norway among others). The trip was financed by the Bohdan Hawrylyshyn Foundation.

New Opinion of the European Copyright Society on Limitations and Exceptions to Copyright in the European Union
The European Copyright Society has released a new Opinion on limitations and exceptions to copyright in the European Union. The Opinion is based on the Judgement of the Court of Justice of the European Union of September 3, 2014 in Case C-201/13 Deckmyn, in which the Court exposes some basic principles about limitations and exceptions to copyright in the European legal order.
The European Copyright Society (ECS) was founded in January 2012 with the aim of creating a platform for independent scholarly thinking on European Copyright Law. Its members are scholars and academics from various countries of Europe, seeking to promote their views of the overall public interest regarding the construction of European Copyright law.
In February 2013, the European Copyright Society issued a remarked opinion on the Svensson case (Case C-466/12) which was referred to the CJEU for a preliminary ruling from the Svea hovrätt (Sweden) on 18 October 2012. Earlier this year, the European Copyright Society has also issued a response to the Public consultation on the review of the EU copyright rules of the European Commission.
The board of the European Copyright Society is currently composed of: Lionel Bently, Centre for Intellectual Property and Information Law (CIPIL), University of Cambridge; Christophe Geiger, Centre for International Intellectual Property Studies (CEIPI), University of Strasbourg (Chair); Raquel Xalabarder, Universitat Oberta de Catalunya (UOC), Barcelona.

Doctoral fellowships
Within the framework of a partnership between the CEIPI and the Association des Conseils en Propriété Industrielle (ACPI), we are looking for a legal scholar with a master’s degree or an LLM in intellectual property who wishes to pursue doctoral studies in intellectual property and write a thesis (in French) on the European patent with unitary effect and on the European Patent Court. The CEIPI will take on academic supervision of the thesis.
